Federal/State ELF for North Dakota returns is open to participants who have been accepted into the IRS e-file program. Once accepted by the IRS, EROs are automatically accepted into North Dakota e-file. No separate North Dakota application is required. 

North Dakota recognizes the federal personal identification number (PIN) as the signature for the North Dakota returns. Therefore, North Dakota Form ND-1EF does not need to be used if federal Form 8879 is used.

North Dakota Form ND-1EF must be signed if federal Form 8453 is used. The ERO must retain the original Form ND-1EF for three years after the return is due, including extensions. The attachments must also be retained during this period whether Form 8879 or Form ND-1EF is used. In the event the STATE requests the original Form ND-1EF or attachments to verify the electronic return, the ERO will be required to submit it to the STATE within five business days.
